Amending the Building Permit and Design During Construction

If the contractor or professional supervision changes, the investor notifies the construction inspector in writing within three days of the change and submits the contract with the new contractor or supervisor (Art. 43 para. 9).

The contractor reports defects in the reviewed main design to supervision immediately (in writing, within one day). Supervision orders the investor to amend and review the design and informs the inspector (Art. 47). For unforeseen circumstances (e.g. insufficient soil bearing capacity, groundwater) the design is amended after the inspector's record, and review is mandatory.

The design may be amended only in line with the valid UTC. If the change does not affect stability and does not alter load-bearing elements or the exterior (e.g. better space organization, replacing installations), the investor submits a notification to the construction inspector (Form 25) with the reviewed amended design. If elements of the conceptual design change, new consent of the architect and an application for a new building permit for the amended design (Form 8) are needed; it is issued within 30 days and cancels the previous one (Art. 48).

Construction must be completed within five years of the permit being issued. For each started year of overrun an annual fee of 5% of the estimated value of the building from the reviewed main design is paid (Decree 147/25, Art. 2), and the site is maintained until the use permit (Art. 43). If you suspend works for more than 30 days, you must close and secure the site (Art. 49).
