Legalization of Illegal Building

A licensed geodetic organization prepares the as-built survey report. You submit the registration application to the Real Estate Administration with a notarized builder's statement that the building was built contrary to regulations (Art. 64a of the Law on State Survey and Cadastre). The deadline to start registration is in Art. 48.

The application is submitted on the prescribed form. Up to 500 m² net area the competent local administration body decides. Over 500 m², for 4–5 star hotels and tourist resorts and for objects in some protected zones (e.g. maritime domain, protected areas, cultural heritage) the state administration body decides (Art. 12). The application is published on the authority's website.

A commission inspects the building and draws up a record (Art. 14). The owner bears the cost of the site visit. Within 15 days of the application the authority calls you to submit, within 90 days, the evidence under Art. 15: settled property relations, proof of arrangement of the urban rehabilitation fee, the special fee (coast), a notarized statement waiving claims against the state and municipality, and proof of stability.

The urban rehabilitation fee is calculated per m² of net area from the survey report, and the municipality sets it by decision. The rate is set by the municipality's decision (with the Government's consent). Reductions: up to 50% for basic housing and buildings of religious communities, up to 90% for socially vulnerable categories and up to 20% for lump-sum payment. Reductions cannot be combined (Art. 23).

The authority issues the legalization decision and publishes it on its website. Within eight days of it becoming final it delivers it to the inspectors and the Cadastre, and the Cadastre enters the annotation about legalization within 40 days (Arts. 12 and 21).
