Notification of Adaptation and Rehabilitation Works

Adaptation or rehabilitation works on an existing building (e.g. rearranging rooms in a flat, replacing installations) do not need a building permit, but they are notified to the construction inspector. If the structure or facade changes, it is reconstruction and a permit is needed.

Adaptation or rehabilitation is a change in the organization of space in a building or replacement of devices, equipment and installations, provided this does not affect stability and safety, does not change load-bearing elements, power up to 15% of capacity (wording introduced by amendment 114/26), design capacity or the exterior, and does not affect neighbours, traffic, fire protection and the environment (Art. 7 para. 1 point 1).

Responsible: Owner / designer
Deadline: 1 day
Note: If the works affect load-bearing elements, the facade or increase capacity, it is reconstruction, extension or superstructure and a building permit is needed (Arts. 33–34). For a larger change of power or capacity ask the inspector. Photovoltaic systems and heat pumps up to 999 kW need no building permit but a notification with technical documentation, and the procedure (up to 30 days) is regulated by the municipal assembly (Art. 74a, amendment 114/26; the rule was to be adopted within 60 days, Art. 146a). Check whether your municipality has adopted that rule and where the notification is filed.
