Temporary stay is granted to a foreigner who intends to stay longer than 90 days, among other reasons in order to use and dispose of real estate that he owns in Montenegro (Article 38 of the Law on Foreigners). Real estate in this sense means family houses, weekend houses, villas, flats, hospitality facilities, residential-business buildings and business premises (Article 56). The general conditions in Article 43: means of support, secured accommodation, health insurance, a valid travel document (valid at least three months longer than the requested stay), no entry ban, no conviction for serious crimes in Montenegro and the country of origin, and no obstacles on grounds of security or public health. Since 17 January 2026 (OG MNE 3/26) this ground also requires proof of the value of the property: a decision of the local tax body determining property transfer tax with a taxable base of not less than €150,000 (Article 56(1) and (4)). This does not apply to citizens of EU member states and their family members, nor to citizens of Iceland, Liechtenstein, Norway and Switzerland (para. 5).

Responsible: Applicant (foreigner)
Deadline: 1–2 days
Documents:
  • Passport
  • Property certificate
  • Property transfer tax decision (base of at least €150,000)
Note: This permit gives the right to stay in line with its purpose (using and disposing of the property), not the right to work. For a foreigner who was issued a permit on this ground before 17 January 2026, an extension application submitted after that date is decided under the earlier rules (Article 217b). If the property was acquired by inheritance or gift and no tax decision was issued, ask the municipality's tax body and the Ministry of Interior how its value is proved. Bylaws are to be harmonised with the amendments within 12 months, and until then the earlier ones apply (Article 216v).
