A mortgage is created by a contract, a court decision or by law, and arises only when entered in the cadastre (article 10 of the Law on Mortgage). The contract must be in writing and certified by the competent authority (article 11). It states the parties, the secured claim, the property (sheet number, parcel, cadastral municipality), the due date and the way of settlement, and the date. For a whole co-owned property all co-owners must consent (article 5); a co-owner may alone encumber only their ideal share. A mortgage cannot arise from a will (article 10).

Responsible: Bank / Creditor and property owner
Deadline: As agreed with the bank
Documents:
  • Mortgage contract (certified)
  • Property sheet
Note: If the contract is a private document, the signatures must be certified (article 87, paragraph 3) and the contract must contain an express consent to registration (intabulation clause, article 88). A notarial deed with that clause is registered in the simplified procedure (article 120).
